Using Tylenol During Pregnancy and Autism Lawsuit Eligibility
Recent studies have highlighted a potential connection between the usage of acetaminophen (the active ingredient in Tylenol) during pregnancy and an increased risk of neurodevelopmental disorders, including autism, in children.
These studies suggest that acetaminophen use during pregnancy could disrupt the normal development of the fetal brain by disturbing the balance between oxidative stress and antioxidant defense mechanisms. This disturbance may lead to inflammation and potentially raise the risk of neurodevelopmental disorders.
Given that millions of individuals rely on Tylenol or generic acetaminophen for mild to moderate pain relief and fever reduction, it is crucial for those potentially affected to come forward and participate in holding Tylenol manufacturers accountable for any potential mistakes.

The growing body of research linking Tylenol to autism has resulted in a surge of product liability lawsuits against major retailers that stock Tylenol or generic acetaminophen. These lawsuits claim that these corporations failed to provide adequate warnings about the potential risk of using their store-brand medication during pregnancy, which could lead to the development of autism or ADHD in children.
In June 2022, a motion was filed to consolidate 19 cases into multidistrict litigation, seeking to streamline the legal proceedings by assigning them to a single judge. Since then, more than 30 related actions have been initiated.
In September 2022, the request for multidistrict litigation was granted.
In November 2022, the initial hearings took place involving Johnson & Johnson and multiple retailers named as defendants in the Tylenol autism lawsuits, including:
- Costco Wholesale Corporation
- CVS Pharmacy, Inc.
- Rite Aid Corporation
- Safeway
- Target Corporation
- Walgreens Company
- Walmart Inc.
Randy Hargrove, a spokesperson for Walmart Inc., placed the responsibility on the manufacturers and distributors of the drugs, stating, “We expect suppliers to provide safe and quality products that comply with all applicable laws, including labeling requirements. We’ll respond in court as appropriate.” Walmart Inc. does not manufacture the drug.
As of December 2022, Walmart has filed an expedited appeal after their request to dismiss two of the cases was denied.
