Copyrights

A copyright is required if you have an original work which you deem exploitable such as music, writing, graphic arts, photography, web design,  or similar such creations.   Copyrighted material is not necessarily unique, but the author must prove that it is original. Two authors may have identical works, but so long as it is proven that both works were created without knowledge of the other, then either or both works can retain a copyright.  If your creation is in a “tangible medium” (written, recorded, published on the web) a copyright registration is necessary (in the U.S.) before you can file an infringement claim in court.  For works deemed unique in their content and origin, a patent or trademark is in order.

Trademark



If you have a logo, business brand name, phrase, symbol or other written or drawn representation it is best to have it trademarked.  Recently, the business industry has seen a boom in small business owners and others with a valuable internet presence having their un-trademarked business names or brands being sold.  The internet pirates attempt to get the business owner to “buy” their own business name or else the pirate company will acquisition it for themselves.  Companies who have already trademarked their names need not worry about losing their valuable brand to name-buyers trying to make a buck.
